At Melehy & Associates, we believe in workers’ rights and in following the law. The workers of this country are diverse—from countries all around the world—and their needs are diverse as well. It is our mission to serve them and to ensure justice is served, no matter what their immigration status may be.
The following is a true story, with names changed to protect the identities of those involved. Juan was working for an employer doing backbreaking physical labor, sometimes up to 70 hours per week. His employer thought that undocumented workers were not entitled to overtime pay and refused to compensate him for any extra time over 40 hours per week. Juan fortunately recognized this situation was unfair and found work elsewhere with fairer terms. However, he decided to pursue legal action against his previous employer so that the company could not continue to exploit others like him.
He hired us and we brought a law suit against the employer to recover the overtime pay he was owed. The employer contacted Juan and told him that if he did not drop the case, he would be charged with a crime which could lead to deportation. Juan was very courageous and refused to drop the case. His former employer carried out the threat and brought false criminal charges against him, but our team responded by doubling down and charging the employer with illegal retaliation. We vigorously prosecuted Juan’s case and, under pressure, his former employer eventually gave up. The charges were dismissed and Juan was paid more than two times his unpaid overtime wages.
There are hundreds of thousands of hard-working men and women like Juan that fall victim to dishonest employers every day. Don’t be one of them! Fight back! Call us right away at 301- 587-6364 for a free consultation to discuss your case.
